These Terms of Service ("Terms") govern your access to and use of fourbics products and services. By using our services, you agree to be bound by these Terms.
Acceptance of Terms
By accessing or using fourbics Client or Server products, you agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Description of Services
fourbics provides EBICS client software for connecting to banks and EBICS server software for financial institutions. Our services enable secure electronic banking communications according to EBICS protocol specifications (H003-H006).
Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and EBICS keys. You must immediately notify us of any unauthorized use of your account. You are responsible for all activities that occur under your account.
Acceptable Use
You agree to use our services only for lawful purposes and in accordance with these Terms. You may not use our services to transmit fraudulent transactions, violate any applicable laws or regulations, or interfere with the proper functioning of our services.
License and Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use our software. You may not reverse engineer, decompile, or disassemble our software, except as permitted by applicable law. You may not sublicense or transfer your license without our written consent.
Payment Terms
Fees for our services are as set forth in your order or subscription agreement. All fees are non-refundable except as expressly stated otherwise. We may change our fees upon 30 days notice.
Warranty Disclaimer
Our services are provided "as is" without warranty of any kind. We do not warrant that our services will be uninterrupted, error-free, or completely secure. We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
Limitation of Liability
To the maximum extent permitted by law, fourbics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless fourbics from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
Termination
Either party may terminate these Terms upon 30 days written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use our services ceases, but provisions that by their nature should survive will remain in effect.
Governing Law and Jurisdiction
These Terms are governed by the laws of Austria, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent court for Lochau, Vorarlberg, Austria.
Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes via email or through our services. Your continued use after changes constitutes acceptance of the modified Terms.
